1. Acceptance of Terms

By accessing and using the Effigiz website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Products and Orders

All products are made to order. The applicable price is the one displayed at the time you place your order. We reserve the right to refuse an order on legitimate grounds, in particular in case of suspected fraud or product unavailability.

3. Custom Portraits

Custom portraits are generated using AI technology. By uploading a photo, you confirm that you have the right to use the image. Generated portraits are for personal use. You retain no copyright over AI-generated artwork.

4. Payment

Payment is processed securely by WooPayments (Stripe) at checkout. Your card details are transmitted directly to the payment provider and are never stored on our servers. All prices include applicable taxes unless stated otherwise. Shipping costs are calculated at checkout.

5. Shipping and Delivery

Delivery times shown on the site are estimates provided for information only. We ship to the European Union, the United States and Canada. The risk of loss of or damage to the product passes to you only when you, or a third party designated by you, take physical possession of it.

6. Right of Withdrawal

For catalog products, you have a statutory right of withdrawal of 14 days from receipt of your order, without having to give any reason. To exercise it, contact us with your order number before this period expires; we will refund all payments received, including standard delivery costs, no later than 14 days after recovering the items. Return shipping costs are borne by you. In accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to personalized products made to your specifications, such as portraits created from your photos.

7. Returns and Refunds

Beyond the statutory right of withdrawal, we accept returns of catalog products for 30 days after delivery. Contact us with your order number to start a return; once we receive the item, we will refund the full price paid. Return shipping costs are borne by the customer. Personalized products created from your photos cannot be returned or exchanged, except if they arrive damaged or defective — in that case we will replace them free of charge when reported within 7 days of delivery.

8. Statutory Warranties

Independently of any commercial return policy, you benefit from the statutory warranties: the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code), for two years from delivery of the product, entitling you to repair or replacement of a non-conforming product or, failing that, a refund; and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), entitling you to return the product or obtain a price reduction. These warranties apply at no additional cost to you.

9. Intellectual Property

All content on this website, including designs, logos, and text, is the property of Effigiz and is protected by applicable intellectual property laws.

10. Limitation of Liability

We cannot be held liable for damage resulting from abnormal use of the product or from force majeure. Nothing in these terms excludes or limits the statutory warranties you benefit from as a consumer, or our liability for personal injury, gross negligence or willful misconduct.

11. Mediation and Disputes

These terms are governed by French law, without prejudice to the mandatory consumer-protection provisions applicable in your country of residence. In the event of a dispute, please contact us first so we can seek an amicable solution. In accordance with Articles L611-1 et seq. of the French Consumer Code, you may have free recourse to a consumer mediator. You may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

12. Changes to These Terms

We reserve the right to update these terms at any time. Changes take effect immediately upon posting. Continued use of our services constitutes acceptance of the updated terms.
